Terms and Conditions

Application: These Terms & Conditions apply whether a contract has been made verbally or in writing. The price agreed between Pendle Coaches Limited and You (the customer) is limited to the information contained in the Requirements section. Once payment has been received for hire the hirer has entered in to a contract with Pendle Coaches Limited. Changes requested to be made after the booking has been confirmed will be at the discretion of Pendle Coaches Limited and may be subject to further charge(s).

Bookings: All bookings made are confirmed by an advanced deposit. The minimum advance deposit is dependent upon the vehicle required and ranges from £50.00 to £100.00. You may pay full amount at the time of booking.

Payment: Payments must be made in full before the requirements commence, unless otherwise stated. If any outstanding monies are due, Pendle Coaches Limited. Reserves the right to delay the travel arrangements till the payment is made in full. You and/or the credit card holder agree that a chargeback will not be charged to any credit card issuing company regards to payment. You may pay in advance by cheque for the balance due allowing sufficient time (minimum 7 days) for the cheque to be cleared in our account prior to the requirements being fulfilled. Cheques are to be made payable to “Pendle Coaches Limited.” Alternatively, cash payments may be accepted if made in person at Unit 4B, Britannia Mill, Windermere Avenue, Burnley, Lancashire, BB10 2AF.

Privacy Policy: We do not store credit card details nor do we share customer details with any 3rd parties.

Animals: Animals will not be carried on any vehicle with the exception of guide dogs and hearing dogs. These need to be notified to Pendle Coaches Limited at the time of booking.

Refund/Cancellations: If the confirmed booking is cancelled within 7 days of the date of travel, all monies paid will be forfeited and the full balance owed will become payable. Payment of the remaining balance owed is payable within five working days from the date of cancellation. If the confirmed booking is cancelled more than 7 days in advance of the date of travel, then 50% of the agreed price becomes payable to Pendle Coaches Limited within 5 days or the deposit paid is forfeited, whichever amount is the greater.

Breakdown: Pendle Coaches Limited makes every effort to maintain its vehicle(s) as often and as thoroughly as possible to ensure, so far it is reasonably able, that the vehicle(s) are in the best and most reliable condition and are thereby fit for purpose of use. Should a mechanical breakdown occur outside its control, Pendle Coaches Limited can neither be held responsible for mechanical breakdown nor for the impact that those unforeseen event(s) may thereafter have caused. In the event of mechanical failure due to circumstances beyond our control, if the vehicle requested cannot be provided either for the first, the final or other interim journeys booked, Pendle Coaches Limited reserves the right to provide substitute vehicle(s) of equal or similar standing and capacity. Where Pendle Coaches Limited is unable to supply alternative transport upon the cancellation of the vehicle, Pendle Coaches Limited may return all monies paid and without further liability will cancel the contract. Pendle Coaches Limited will endeavour to assist the hirer by supplying contact numbers for other coach operators who may be able to provide replacement hire. You and your passengers should have adequate travel insurance in the event of such a cancellation to cover unforeseen travelling cost, expenses and losses.

Route: Unless confirmed otherwise, the route taken will be at the discretion of Pendle Coaches Limited and/or the driver. The vehicle will depart at the times agreed by the hirer, and it is the responsibility of the hirer to account for all passengers at those times.

Grace Period: Pendle Coaches Limited will endeavour to be at all pick–up point(s) in advance of the time(s) agreed. However, there may be causes beyond our control that may prevent us from meeting these commitments, including (but not limited to): inclement weather, road traffic accidents, road resurfacing etc. Therefore, a period of up to 30 minutes grace is to be allowed by you. Should the driver be required to invoke, in whole or in part, a grace period time of adjusted time(s) will be made up during or after the period of hire, schedules permitting. The driver will be at reasonable speeds keeping within the law, and will use their judgement in relation to the prevailing road type and conditions. Pendle Coaches Limited neither accepts any responsibility nor can it be held liable in any way whatsoever for any unavoidable delays howsoever caused.

Drivers Hours: The hours of the operation of the driver are regulated by the law and You accept the responsibility of ensuring the hire keeps to the hours and times agreed by Pendle Coaches Limited. Neither You nor any passengers shall delay or otherwise interrupt the journey in such a way so as to place the driver at risk of breaching regulations relating to the driver’s hours and duty time. If any breach is likely to occur then You will be responsible for any additional costs noted on Vehicle Overtime Rate.

Property: Pendle Coaches Limited will not accept liability for any damages or loss of property that is left in any vehicle either during or after the final drop off point. Any items of lost property recovered from the vehicles will be held at the depot where the vehicle is based. It is Your responsibility to recover the said property from us and to bear the cost of collection. If You, or the owner of the lost property, wish to collect the property in person, an appointment with Pendle Coaches Limited must be made prior to collection.

Seating capacity: The maximum number of passengers permitted to travel in the vehicle is indicated within the vehicle. No standing passengers will be allowed to travel unless the vehicle specifically permits standing passengers. Drivers will not permit extra passengers to travel over the seating capacity, which can be altered at Pendle Coaches Limited’s discretion without prior notice. Conduct of passengers. The driver is responsible for the safety of the vehicle. Any passengers who conduct themselves in such a manner that, in the driver’s opinion, is in the breach of statutory regulations will be removed from the vehicle. You are responsible for all damage caused to (and soiling caused within) the vehicle by any of the passengers during the hire of the vehicle. For the avoidance of doubt, Pendle Coaches Limited reserves the right to terminate any and all services to unruly or abusive passengers.

Complaints: Must be made within 7 days of hire in writing to Pendle Coaches Limited, Unit 4B, Britannia Mill, Windermere Avenue, Burnley, Lancashire, BB10 2AF. Pendle Coaches Limited only accepts standard postal letters and not recorded delivery. You and/or the card holder agree that if there is a dispute regarding a booking a chargeback request will not be raised through any card issuer or bank.

Alcohol: Under no circumstances may alcoholic drinks be carried onboard or consumed upon any of our vehicles as it is against the law. Passengers carrying sports bags or rucksacks may be asked to open them and any alcohol or bottles must be left outside the coach. Anyone who refuses to comply will not be permitted to travel.

Smoking: Pendle Coaches Limited operates a strict “NO SMOKING” policy within their vehicle(s). Should this condition be ignored the driver is authorised to terminate the hire agreement immediately and a refund will not be offered under any circumstances.

Surcharges: Pendle Coaches Limited reserves the right to charge a valeting charge for any soiling or damages of vehicles made by You or your passengers. Depending upon the type of vehicle hired, we will charge a valeting fee of £50.00 – £100.00 to make good the vehicle. Should the vehicle require further specialist or non-routine cleaning as a result of the conduct of You or your party, in particular for the removal of vomit and disinfecting of affected areas, then without prejudice to its other rights and remedies Pendle Coaches Limited shall be entitled to recharge the cost of such cleaning to You. Pendle Coaches Limited will invoice You directly and should the additional payment(s) not be made on the day or night, the fee is payable in full within 5 working days of the date of hire.

Airport Requirements: Where Pendle Coaches Limited are retained to collect the customer from arriving flight(s) in particular inbound international flight(s), You are required to telephone +44 (0) 1282 45 00 88 before leaving the departure airport to reconfirm the pick – up requirements from Pendle Coaches Limited. Upon arrival in the UK airport, once you have cleared customs you are required to call Pendle Coaches Limited to either obtain the driver’s mobile number so that you may direct him/her to yourself or our staff in the office will ask you to stand at a particular point in arrivals. The following locations are our pick–up points: Manchester Airport: T1 – wait outside Departure Parking or bus stop opposite taxi rank, T2 – outside New Bus stop for pick up and drop off points, T3 – outside designated pick-up/drop off points. Pendle Coaches Limited will not be held liable for any delays or inconveniences howsoever caused if any or the whole of the foregoing is not complied with. All car parking charges incurred by Pendle Coaches Limited during return journey are to be paid by You.

General Matters: These Terms and Orders made in accordance with the terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts. If any of these Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms which will continue to be valid and enforceable to the fullest extent permitted by law. Pendle Coaches Limited will not be held responsible for the use or transportation of any illegal substance or articles within their vehicle(s). The hire agreement will be terminated immediately without refund if The Customer contravenes this condition. We at Pendle Coaches Limited want to ensure your experience with us is a good one. On some coach trips such as Stag/hen parties, on boarding the driver will have the authority to request an advance £100 – £150 security deposit depending on the vehicle hired. The deposit is returnable at the end of the journey provided the coach returns in the same condition as prior to the journey. At the end of the journey, the driver will check for damage to seats, interior, rubbish or wet seats. Defects found will be regarded as a breach of terms and the driver will have the authority to retain all or part of the deposit. Disputes will NOT be handled on the day. These will be handled on the next working day either by e-mail or telephone as outlined under condition 13.

PLEASE NOTE: Condition 2 and condition 3 do not apply to schools or other account customers. In these cases an invoice will be sent with payment terms of strictly 14 days.

Also note that by contacting us directly via phone, email or submitting your inquiry online for a quotation through this website, you are agreeing that we may pass your details to a third party operator to contact you with the relevant quotation / information if needed. We may do this in the busiest season of the year or due to lack of availability. But we are still doing our best to provide the best possible service to you at all times.
